Colin argues that the SRA Principles, particularly that which requires solicitors to act 'with integrity' must be kept firmly in mind, even in the pursuit of a client's best interests. He also assesses the Legal Services Board's recent consultation on its proposes to impose some onerous new regulations around the ethical conduct of lawyers, which is premised on flawed assumptions. Colin concludes that the safest course may be for so-called 'evidence gatherers' to be used 'very rarely indeed, if at all'.
